Standards for Backup Journal


Delaware Notaries shall maintain a live journal as well as a backup.  The backup should be in an alternative storage device, it cannot share the same device as the live copy.  Example devices include an external hard drive or thumb drive, or a cloud-based platform.  Access to this backup should only be by the Notary, no other individuals should have access. Additionally:

  • The backup must be specifically labeled as the backup journal.
  • The backup must be updated at the close of business each day a notarial act was performed.
  • The backup must be in the same format as the live copy, it cannot be in a different format.
  • The backup must be kept for 10 years after the last notarial act was conducted.  Alternatively, along with the live copy, the backup can be furnished to the Notary Administrator if a notary chooses to not renew their commission.
  • Upon revocation or death of the notary, the backup must also be given to the Notary Administrator along with the live journal.
